These Top-Up Terms (the "Top-Up Terms") govern all purchases of virtual currency, virtual items, subscriptions, bundles, and any other paid features offered in or in connection with Ether Online (each, a "Top-Up" or a "Purchase"). They form part of, and are incorporated by reference into, the Ether Online Terms of Service. Capitalized terms not defined here have the meaning given to them in the Terms of Service.
Important. By making a Top-Up, you agree to these Top-Up Terms, the Terms of Service, the Official Rules, and the Privacy Policy. If you do not agree, do not make a Top-Up.
1. Definitions
1.1. "Virtual Currency" means any in-game currency that can be obtained through a Top-Up (for example, premium coins, gems, or similar), whether purchased directly or received as part of a bundle, event, or promotion.
1.2. "Virtual Items" means any in-game items, cosmetics, characters, character slots, expansions, passes, bundles, service upgrades, boosts, memberships, or other digital content that can be obtained through a Top-Up.
1.3. "Payment Method" means any credit card, debit card, e-wallet, mobile payment, prepaid card, app store account, or other means of payment we or our payment processors accept.
1.4. "Payment Processor" means the third-party service that actually processes your Payment Method (for example, an app store, a card network, or a payment gateway).
2. Eligibility to Purchase
2.1. You may only make a Top-Up if you (a) have a valid Ether Online account in good standing, (b) meet the age and eligibility requirements of the Terms of Service, and (c) are legally permitted to use the Payment Method you are using.
2.2. If you are a minor at or above the legally required minimum age but below the age of majority in your jurisdiction, you may only make a Top-Up with the express, verifiable consent of a parent or legal guardian, who is responsible for the transaction.
2.3. You represent that any Payment Method you use is your own, or that you have the account holder's clear, verifiable authorization to use it, and that you have the funds or credit to complete the Purchase.
3. The Purchase Process
3.1. How Purchases work. When you initiate a Top-Up, you select the offer, review the price and contents on the confirmation screen, and confirm the Purchase using your Payment Method. Once you confirm, the Purchase is submitted for processing.
3.2. Confirmation is your responsibility. You are responsible for reviewing the price, quantity, contents, currency, and Payment Method before confirming. Confirming a Top-Up is a binding request to complete the Purchase.
3.3. When the Purchase becomes final. A Purchase is complete when your Payment Method has been successfully charged and the Virtual Currency or Virtual Items have been credited to your account. Delivery normally occurs promptly, though we do not guarantee any specific timeframe.
3.4. Failed or delayed deliveries. If your Payment Method is charged but delivery does not occur within a reasonable time, contact support with the transaction reference. We will investigate and, if appropriate, credit the Purchase or issue a refund. We may need information from you to complete the investigation.
3.5. Right of cancellation / withdrawal. Where applicable law grants you a statutory right of withdrawal or cancellation for digital content, you acknowledge and expressly agree that (to the extent permitted by that law) performance of your Purchase begins immediately upon confirmation and that your right of withdrawal is therefore lost once the Virtual Currency or Virtual Items are delivered to your account. Where mandatory law grants you a longer or non-waivable right, that law prevails.
4. Pricing, Taxes, and Currency
4.1. Prices. All prices are displayed at the point of Purchase and are subject to change at any time. Price changes do not affect Purchases already completed.
4.2. Taxes. Prices may be shown inclusive or exclusive of applicable taxes, depending on your jurisdiction and Payment Method. You are responsible for any taxes, duties, or fees imposed by your jurisdiction that are not collected by us or the Payment Processor.
4.3. Currency conversion. If your Payment Method is denominated in a currency different from the currency in which the Purchase is priced, your Payment Processor may apply its own conversion rate and fees, for which we are not responsible.
4.4. Payment Processor fees. Certain Payment Methods may impose additional fees. Those fees are between you and the Payment Processor.
5. Virtual Currency and Virtual Items — Nature of What You Receive
5.1. License, not sale. Virtual Currency and Virtual Items are licensed to you for personal, in-game use only. You do not own them, and you do not acquire any right, title, or interest in them.
5.2. No monetary value. Virtual Currency and Virtual Items have no real-world monetary value. They cannot be redeemed for cash or any other form of real-world consideration from us. Any perceived market value created by players, third parties, or unauthorized services is not recognized by us and does not create any obligation on our part.
5.3. Non-transferable outside the game. Virtual Currency and Virtual Items may not be sold, gifted, transferred, or exchanged outside the systems we expressly provide within the Service.
5.4. Modifiable and revocable. We may, at our sole discretion and to the extent permitted by law, modify, replace, rebalance, suspend, restrict, or remove any Virtual Currency or Virtual Item, or change how it can be obtained or used, at any time, with or without notice. This includes removing content associated with discontinued features, events, or servers.
5.5. No guaranteed availability. We do not guarantee that any specific Virtual Item, Virtual Currency, offer, event, promotion, or server will remain available for any period of time.
5.6. Expiration. Some Virtual Items or bonuses may have expiration dates, use limits, level requirements, or other conditions. These will be indicated at the point of Purchase where applicable.
6. Refund Policy
6.1. General rule. Except as required by applicable mandatory law or expressly stated in these Top-Up Terms, all Purchases are final and non-refundable once the Virtual Currency or Virtual Items have been delivered to your account.
6.2. When we may issue a refund. We may, in our sole discretion, issue a refund or in-game credit in situations such as: verified duplicate charges; verified non-delivery not caused by you; a Purchase clearly made without the account holder's authorization that we are satisfied is not fraudulent on the requester's part; or where required by applicable law.
6.3. When refunds will generally not be issued. Refunds will generally not be issued for, without limitation: buyer's remorse; changes to Virtual Items, Virtual Currency, game balance, or the Service after Purchase; account suspension or termination for violation of the Terms of Service, Official Rules, or these Top-Up Terms; loss of Virtual Currency or Virtual Items due to your own actions (for example, being scammed by another player, mistakenly consuming or spending an item, or losing access to your account through poor security); or Purchases that have already been consumed, used, spent, converted, transferred, or otherwise applied within the Service.
6.4. Payment Processor refund windows. Some Payment Processors (for example, certain app stores) operate their own refund policies. Where your Purchase was made through such a Payment Processor, refunds may be subject to their policy in addition to, or instead of, ours. You may need to contact them directly.
6.5. Refund requests. To request a refund, contact support with the transaction reference, date, Payment Method, and reason. We may require additional information to verify the request.
7. Chargebacks and Payment Disputes
7.1. Contact us first. If you believe there is a problem with a Purchase, please contact us before initiating a chargeback or payment dispute with your Payment Processor. Most issues can be resolved directly.
7.2. Chargebacks are treated seriously. Filing a chargeback or payment dispute — particularly one that is unjustified, fraudulent, or intended to reverse a Purchase you actually authorized and received — is a serious matter. Upon notice of a chargeback or dispute, we may, in our sole discretion and to the extent permitted by law:
- (a) reverse, remove, or clawback the Virtual Currency, Virtual Items, or any other content associated with the disputed Purchase, including from other characters, accounts, or players who have received them;
- (b) reverse, remove, or clawback any items, currency, or progress subsequently obtained using the disputed Purchase;
- (c) restrict, suspend, or permanently ban the account and any linked accounts;
- (d) block the associated Payment Method, IP address, device, or identity from future Purchases;
- (e) recover any amount, fee, or cost we incur as a result of the chargeback;
- (f) refuse future service to you.
7.3. Reversal of resulting advantages. Any rankings, event results, competitive rewards, or in-game standings obtained wholly or partly through the disputed Purchase may be adjusted, forfeited, or reversed.
7.4. Legitimate disputes. These consequences are not intended to penalize good-faith disputes over genuine fraud or Payment Processor errors. If you believe a chargeback was warranted, contact us and we will work with you to resolve the situation.
8. Fraud, Anti-Money-Laundering, and Prohibited Uses
8.1. Fraud prevention. We may screen, hold, delay, decline, cancel, or reverse any Purchase we reasonably suspect is fraudulent, unauthorized, or in violation of our rules, applicable law, or a Payment Processor's rules.
8.2. Prohibited Top-Up conduct. You must not, and must not attempt to, and must not assist any other person to:
- (a) use stolen, lost, unauthorized, or otherwise illegitimate Payment Methods or accounts;
- (b) use another person's Payment Method without that person's clear, verifiable authorization;
- (c) file, threaten, or encourage unjustified chargebacks or payment disputes;
- (d) engage in "friendly fraud" or otherwise misrepresent that a Purchase was unauthorized when it was not;
- (e) obtain Virtual Currency or Virtual Items through duplication, exploits, cheats, bug abuse, gifting loops, or any unintended mechanic;
- (f) manipulate promotions, discounts, region pricing, currency conversion, promo codes, referral programs, or first-purchase offers by using multiple accounts, false identities, false locations, VPNs, proxies, or similar means;
- (g) resell, transfer, exchange, launder, broker, or advertise Virtual Currency, Virtual Items, or Purchase-linked assets for real-world value, cryptocurrency, or any other consideration outside the systems we expressly authorize;
- (h) purchase, sell, gift, or transfer Virtual Currency or Virtual Items with the intent, or on behalf of another party with the intent, to circumvent an active ban, restriction, or enforcement action;
- (i) use the Purchase system to launder proceeds of any activity, or for any unlawful purpose;
- (j) reverse-engineer, tamper with, or manipulate the Purchase flow, prices, receipts, tokens, entitlements, or delivery systems;
- (k) create fake receipts, fake payment confirmations, fake support tickets, or fake staff messages to obtain Virtual Currency, Virtual Items, refunds, or benefits;
- (l) exploit any pricing error, display error, or promotional error where a reasonable person would recognize that the offer is not what was intended.
8.3. Consequences. Violations may result in any combination of: cancellation and reversal of Purchases; removal of all associated Virtual Currency, Virtual Items, and downstream items or currency; forfeiture of related rewards, rankings, and progress; temporary or permanent bans of the account and any linked accounts; blocking of Payment Methods, devices, and identifiers; recovery of costs incurred by us; and reporting to Payment Processors, law-enforcement authorities, or other appropriate parties as permitted by law.
8.4. Multi-account and identity abuse. Where a single person, household, or organization operates multiple accounts to abuse Top-Ups, promotions, or refund processes, we may treat all such accounts as a single unit for enforcement purposes.
9. Promotions, Bundles, and Bonus Content
9.1. Terms of specific offers. Promotions, bundles, limited-time offers, first-purchase bonuses, event passes, and similar offers may be subject to additional, offer-specific terms displayed at the point of Purchase. Those terms form part of these Top-Up Terms for that Purchase.
9.2. One per eligible account, unless stated. Unless expressly stated otherwise, first-time and one-time bonuses are limited to one per eligible person, regardless of how many accounts they operate.
9.3. Promo codes. Promo codes must be used in accordance with their stated conditions and only by their intended recipients. Codes obtained through fraud, theft, or unauthorized distribution are void.
9.4. Pricing and display errors. If a price, offer, or bundle is displayed incorrectly due to an obvious error, we reserve the right to cancel, correct, or void affected Purchases, and to refund the amount paid, to the extent permitted by law.
10. Third-Party Payment Processors and App Stores
10.1. When you make a Purchase through a third-party Payment Processor or app store, that party's terms, refund policies, dispute processes, and privacy practices also apply. We are not responsible for their acts, omissions, downtime, fees, or decisions.
10.2. If a Payment Processor reverses, holds, refunds, or otherwise adjusts a Purchase, we may adjust your account correspondingly, including by removing the associated Virtual Currency, Virtual Items, and any resulting content, and by taking further action under Section 7.
11. Account Termination and Top-Ups
11.1. If your account is terminated — for any reason, including violation of the Terms of Service, Official Rules, or these Top-Up Terms — you will lose access to all associated Virtual Currency, Virtual Items, purchases, characters, and progress.
11.2. Except as required by applicable mandatory law, termination does not entitle you to any refund of amounts previously paid.
12. Changes to These Top-Up Terms and to Offers
We may update these Top-Up Terms and modify, add, or discontinue Top-Up offers at any time. Material changes to these Top-Up Terms will be communicated through reasonable means. Your continued use of the Top-Up system after the effective date of the updated Top-Up Terms constitutes your acceptance of the changes, to the extent permitted by law. Changes to individual offers do not affect Purchases already completed.
13. Anti-Loophole Clause
13.1. These Top-Up Terms are to be interpreted in accordance with their purpose. You may not do indirectly, through a nominee, through a technicality, or through unintended interactions between features, what these Top-Up Terms prohibit directly.
13.2. The absence of a specific prohibition does not create a right or permission. Where a Purchase-related behavior clearly harms the Service, its economy, its players, our Payment Processors, or the intent of an offer, we may treat it as prohibited and take appropriate action.
13.3. The lists in these Top-Up Terms are illustrative and never exhaustive.
